PRIVACY POLICY OF GIGSTA APP, A MOBILE APP DEVELOPED AND LAUNCHED BY
M/S.GIGSTA TECHNOLOGIES PRIVATE LIMITED, BENGALURU, INDIA.

Your privacy matters to GIGSTA Technologies Private Limited (the “Company”, “we”, “Gigsta”,
or “us”). This Privacy Policy explains how we collect, process, use, share and protect information
about you. It also tells you how you can access and update your information and make certain choices
about how your information is used.
The Privacy Policy covers both “online” (e.g., web and mobile services, including any websites
operated by us such as https://www.gigsta.in/ or Mobile Application, however accessed and/or used,
whether via personal computers, mobile devices or otherwise) and “offline” (e.g., collection of data
through mailings, telephone, or in person) activities owned, operated, provided, or made available by
the Company. Our “online” and “offline” activities, in relation to facilitation of services through a
network of third party Advocates, are collectively referenced as the “Services”. This Privacy Policy
also applies to your use of interactive features or downloads that: (i) we own or control; (ii) are
available through the Services; or (iii) interact with the Services and post or incorporate this Privacy
Policy.
BY ACCEPTING THE GIGSTA TERMS AND CONDITIONS, YOU AGREE TO THE TERMS OF
THIS PRIVACY POLICY. Please review the following carefully so that you understand our privacy
practices. If you do not agree to this Privacy Policy, do not accept GIGSTA Terms and Conditions or
use our Services. This Privacy Policy is incorporated by reference into the GIGSTA Terms and
Conditions.

1. DEFINITIONS:
Unless otherwise provided in this Privacy Policy, the terms capitalized in the Privacy Policy shall
have the meaning as provided hereunder:
i. “Co-branded Services” shall have the meaning assigned to the term in paragraph 4(c) hereto.
ii. “Device” shall mean computer, mobile or other device used to access the Services.
iii. “Device Identifier” shall mean IP address or other unique identifier for the Device.
iv. “Mobile Application” shall mean application provided by us on the Device to access the
Services.
v. “Mobile Device Information” shall have the meaning assigned to the term in paragraph
2(d)(ii) hereto.
vi. “Promotion” shall mean any contest and other promotions offered by us.
vii. “Protected Information” shall mean such categories of information that could reasonably be
used to identify you personally, including your name, e-mail address, and mobile number.
viii. “TPSP” shall mean a third party service provider.
ix. “Usage Information” shall have the meaning assigned to the term in paragraph 2(b)(i) hereto.
2. WHAT INFORMATION DO WE COLLECT?
a) INFORMATION YOU PROVIDE TO US
We may ask you to provide us with certain Protected Information. We may collect this
information through various means and in various places through the Services, including
account registration forms, contact us forms, or when you otherwise interact with us. When
you sign up to use the Services, you create a user profile. We shall ask you to provide only
such Protected Information which is for lawful purpose connected with our Services and
necessary to be collected by us for such purpose.
The current data fields that might be requested for are:
i. Enrolment Number
ii. UPI ID / Bank Account
iii. Email
iv. Password
v. Name
vi. Address
vii. Mobile phone Number
viii. Student ID
ix. Aadhar Card
x. Zip Code
b) INFORMATION WE COLLECT AS YOU ACCESS AND USE OUR SERVICES
In addition to any Protected Information or other information that you choose to
submit to us, we and our TPSP may use a variety of technologies that automatically
(or passively) collect certain information whenever you visit or interact with the
Services (“Usage Information”). This Usage Information may include the browser
that you are using, the URL that referred you to our Services, all of the areas within
our Services that you visit, and the time of day, among other information. In addition,
we collect your Device Identifier for your Device. A Device Identifier is a number
that is automatically assigned to your Device used to access the Services, and our
computers identify your Device by its Device Identifier.
In case of Task via call centre, Gigsta may record calls for quality and training
purposes.
In addition, tracking information is collected as you navigate through our Services,
including, but not limited to geographic areas. The Advocate’s mobile phone will
send your GPS coordinates, during the Task charge, to our servers. Most GPS
enabled mobile devices can define one’s location to within 50feet.
Usage Information may be collected using a cookie. If you do not want information to
be collected through the use of cookies, your browser allows you to deny or accept
the use of cookies. Cookies can be disabled or controlled by setting a preference
within your web browser or on your Device.
If you choose to disable cookies or flash cookies on your Device, some features of the
Services may not function properly or may not be able to customize the delivery of
information to you. The Company cannot control the use of cookies (or the resulting
information) by third parties, and use of third party cookies is not covered by our
Privacy Policy.
c) INFORMATION THIRD PARTIES PROVIDE ABOUT YOU
We may, from time to time, supplement the information we collect about you through our
website or Mobile Application or Services with outside records from third parties.
d) INFORMATION COLLECTED BY MOBILE APPLICATIONS
Our Services are primarily provided through the Mobile Application. We may collect
and use technical data and related information, including but not limited to, technical
information about your device, system and application software, and peripherals, that
is gathered periodically to facilitate the provision of software updates, product
support and other services to you (if any) related to such Mobile Applications.
When you use any of our Mobile Applications, the Mobile Application may
automatically collect and store some or all of the following information from your
mobile device (“Mobile Device
Information”), in addition to the Device Information, including without limitation:
i. Your preferred language and country site (if applicable)
ii. The manufacturer and model of your mobile device
iii. Your mobile operating system
iv. The type of mobile internet browsers you are using
v. Your geo-location
Information about how you interact with the Mobile Application and any of our web
sites to which the Mobile Application links, such as how many times you use a
specific part of the Mobile Application over a given time period, the amount of time
you spend using the Mobile Application, how often you use the Mobile Application,
actions you take in the Mobile Application and how you engage with the Mobile
Application
Information to allow us to personalize the services and content available through the
Mobile Application
Data from SMS/ text messages upon receiving Device permissions for the purposes
of (i) issuing and receiving one time passwords and other device verification, and (ii)
automatically filling verification details during financial transactions, either through
us or a third-party service provider, in accordance with applicable law. We do not
share or transfer SMS/ text message data to any third party other than as provided
under this Privacy Policy.
3. USE OF INFORMATION COLLECTED:
i. Our primary goal in collecting your information is to provide you with an enhanced
experience when using the Services. We use your information to closely monitor which
features of the Services are used most, to allow you to view your task history, rate tasks, and
to determine which features we need to focus on improving, including usage patterns and
geographic locations to determine where we should offer or focus services, features and/or
resources.
ii. Based upon the Protected Information you provide us when registering for an account, we
will send you a welcoming email to verify your username and password.
iii. We use the information collected from our Mobile Application so that we are able to serve
you the correct app version depending on your device type, for troubleshooting and in some
cases, marketing purposes.
iv. We use your Internet Protocol (IP) address to help diagnose problems with our computer
server, and to administer our web site(s). Your IP address is used to help identify you, but
contains no personal information about you.
v. We will send you strictly service-related announcements on rare occasions when it is
necessary to do so. For instance, if our Services are temporarily suspended for maintenance,
we might send you an email. If you do not wish to receive them, you have the option to
deactivate your account.
vi. We may use the information obtained from you to prevent, discover and investigate violations
of this Privacy Policy or any applicable terms of service or terms of use for the Mobile
Application, and to investigate fraud, chargeback or other matters.
vii. We provide some of your Protected Information (such as your name, pick up address, contact
number) to the Advocate who accepts your request for task completion so that the Advocate
may contact and find you. The Companies for whom this App is sold/assigned/access given
for are providing service are also able to access your Protected Information, including your
geo-location data.
viii. We also provide your information to the other users who shall be doing the task assigned by
you.
ix. We use that geo-location information for various purposes, including for you to be able to
view the Advocates in your area that are close to your location, for you to set your task
location, for the Advocates to identify the task and location, to send you promotions and
offers, and to allow you (if you choose through any features we may provide) to share this
information with other people.
x. In addition, we may use your Protected Information or Usage Information that we collect
about you: (1) to provide you with information or services or process transactions that you
have requested or agreed to receive including to send you electronic newsletters, or to provide
you with special offers or promotional materials on behalf of us or third parties; (2) to enable
you to participate in a variety of the Services’ features such as online or mobile entry
sweepstakes, contests or other promotions; (3) to contact you with regard to your use of the
Services and, in our discretion, changes to the Services and/or the Services’ policies; (4) for
internal business purposes; (5) for inclusion in our data analytics; and (6) for purposes
disclosed at the time you provide your information or as otherwise set forth in this Privacy
Policy.
xi. We may share the information collected from you with Third Party Service Providers if you
choose to avail of any services offered by them on the Mobile Application.
xii. We may use the information collected from you for targeted advertising. This involves using
information collected on an individual's web or mobile browsing behavior such as the pages
they have visited or the searches they have made. This information is then used to select
which advertisements should be displayed to a particular individual on websites other than
our web site(s). The information collected is only linked to an anonymous cookie ID
(alphanumeric number); it does not include any information that could be linked back to a
particular person, such as their name, address or credit card number.
4. HOW AND WHEN DO WE DISCLOSE INFORMATION TO THIRD PARTIES:
We do not sell, share, rent or trade the information we have collected about you, other than as
disclosed within this Privacy Policy or at the time you provide your information. Following are the
situations when information may be shared:
i. WHEN YOU AGREE TO RECEIVE INFORMATION FROM THIRD PARTIES.
You may be presented with an opportunity to receive information and/or marketing offers
directly from third parties. If you do agree to have your Protected Information shared, your
Protected Information will be disclosed to such third parties and all information you disclose
will be subject to the privacy policy and practices of such third parties. We are not responsible
for the privacy policies and practices of such third parties and, therefore, you should review
the privacy policies and practices of such third parties prior to agreeing to receive such
information from them. If you later decide that you no longer want to receive communication
from a third party, you will need to contact that third party directly.
ii. THIRD PARTIES PROVIDING SERVICES ON OUR BEHALF
We may use third party companies and individuals to facilitate our Services, provide or
perform certain aspects of the Services on our behalf –as they work for to provide the
Services, other third parties including Third Party Service Providers to host the Services,
design and/or operate the Services’ features, track the Services’ analytics, process payments,
engage in anti-fraud and security measures, provide Customer/Task Creator support, provide
geo-location information to our Advocates, enable us to send you special offers, host our job
application form, perform technical services (e.g., without limitation, maintenance services,
database management, web analytics and improvement of the Services‘ features), or perform
other administrative services. These third parties will have access to user information,
including Protected Information to only carry out the services they are performing for you or
for us. Each of these third parties including Third Party Service Providers are required to
ensure the same level of data protection as us and are obligated not to disclose or use
Protected Information for any other purpose. Analytics may set and access their own cookies,
web beacons and embedded scripts on your Device and they may otherwise collect or have
access to information about you, including non-personally identifiable information.
We use a third party hosting provider who hosts our support section of our website.
Information collected within this section of our website by such third party is governed by our
Privacy Policy.
iii. CO-BRANDED SERVICES.
Certain aspects of the Services may be provided to you in association with third parties (“CoBranded Services”) such as sponsors and charities, and may require you to disclose Protected
Information to them. Such Co-Branded Services will identify the third party. If you elect to
register for products and/or services through the Co-Branded Services, you shall have deemed
to consent to providing your information to both us and the third party. Further, if you sign-in
to a Co-Branded Service with a username and password obtained through our Services, your
Protected Information may be disclosed to the identified third parties for that Co-Branded
Service and will be subject to their posted privacy policies.
iv. CONTESTS AND PROMOTIONS
We may offer Promotions through the Services that may require registration. By participating
in a Promotion, you are agreeing to official rules that govern that Promotion, which may
contain specific requirements of you, including, allowing the sponsor of the Promotion to use
your name, voice and/or likeness in advertising or marketing associated with the Promotion.
If you choose to enter a Promotion, you agree that your Protected Information may be
disclosed to third parties or the public in connection with the administration of such
Promotion, including, in connection with winner selection, prize fulfilment, and as required
by law or permitted by the Promotion’s official rules, such as on a winners list.
v. ADMINISTRATIVE AND LEGAL REASONS
We cooperate with Government and law enforcement officials and private parties to enforce
and comply with the law. Thus, we may access, use, preserve, transfer and disclose your
information (including Protected Information, IP address, Device Information or geo-location
data), to Government or law enforcement officials or private parties as we reasonably
determine is necessary and appropriate: (i) to satisfy any applicable law, regulation,
subpoenas, Governmental requests or legal process; (ii) to protect and/or defend the Terms
and Conditions for online and mobile Services or other policies applicable to any online and
mobile Services, including investigation of potential violations thereof; (iii) to protect the
safety, rights, property or security of the Company, our Services or any third party; (iv) to
protect the safety of the public for any reason; (v) to detect, prevent or otherwise address
fraud, security or technical issues; and /or (vi) to prevent or stop activity we may consider to
be, or to pose a risk of being, an illegal, unethical, or legally actionable activity.
vi. WHEN YOU SHARE INFORMATION
Protected Information may be collected and shared with third-parties if there is content from
the Mobile Application that you specifically and knowingly upload to, share with or transmit
to an email recipient, online community, website, or to the public, e.g. uploaded photos,
posted reviews or comments, or information about you or your Task charge that you choose
to share with others through features which may be provided on our Services. This uploaded,
shared or transmitted content will also be subject to the privacy policy of the email, online
community website, social media or other platform to which you upload, share or transmit the
content.
vii. BUSINESS TRANSFER
We may share your information, including your Protected Information and Usage Information
with our parent, subsidiaries and affiliates for internal reasons, including business and
operational purposes. We also reserve the right to disclose and transfer all such information:
(i) to a subsequent owner, co-owner or operator of the Services or applicable database; or (ii)
in connection with a corporate merger, consolidation, restructuring, the sale of substantially
all of our membership interests and/or assets or other corporate change, including, during the
course of any due diligence process.
viii. MARKET STUDY AND OTHER BENEFITS
We may share your information, including your Protected Information and Usage Information
with third parties for any purpose, including but not limited to undertaking market research/
study, conduct data analysis, determine and customize product or service offerings, to
improve the products or Services or to make any other benefits/products/ services available to
you.
ix. WITH THE OWNER OF GIGSTA ACCOUNTS THAT YOU MAY USE
If you use an account or profile associated with another party we may share the details of the
trip with the owner of the profile. This may occur:
A. If you use your employer’s profile under a corporate arrangement;
B. If you take task arranged by a friend.
5. THIRD PARTY CONTENT AND LINKS TO THIRD PARTY SERVICES:
The Services may contain content that is supplied by a third party, and those third parties may collect
website usage information and your Device Identifier when web pages from any online or mobile
Services are served to your browser. In addition, when you are using the Services, you may be
directed to other sites or applications that are operated and controlled by third parties that we do not
control. We are not responsible for the privacy practices employed by any of these third parties. For
example, if you click on a banner advertisement, the click may take you away from one of our
websites onto a different web site. These other web sites may send their own cookies to you,
independently collect data or solicit Protected Information and may or may not have their own
published privacy policies. We encourage you to note when you leave our Services and to read the
privacy statements of all third party web sites or applications before submitting any Protected
Information to third parties.
6. SOCIAL MEDIA FEATURES AND WIDGETS:
Our online and mobile Services may include social media features, such as the Facebook Like button,
and widgets such as a “Share this” button, or interactive mini-programs that run on our online and
mobile Services. These features may collect your IP address, photograph, which page you are visiting
on our online or mobile Services, and may set a cookie to enable the feature to function properly.
Social media features and widgets are either hosted by a third party or hosted directly on our online
Services. Your interactions with these features and widgets are governed by the privacy policy of the
company providing them.
7. INFORMATION COLLECTED BY ADVOCATES:
This Privacy Policy shall not cover the usage of any information about you which is obtained by the
Advocate or the company to which the Advocate belongs, while providing you a Task charge on a cab
booked using the Services, or otherwise, which is not provided by us.
8. CHANGE OF INFORMATION AND CANCELLATION OF
ACCOUNT:
a. You are responsible for maintaining the accuracy of the information you submit to us, such as
your contact information provided as part of account registration. If your Protected
Information changes, or if you no longer desire our Services, you may correct, delete
inaccuracies, or amend information by making the change on our member information page
or by contacting us through email address mentioned on our website or Mobile Application.
We will make good faith efforts to make requested changes in our then active databases as
soon as reasonably practicable.
b. You may also cancel or modify your communications that you have elected to receive from
the Services by following the instructions contained within an e-mail or by logging into your
user account and changing your communication preferences.
c. If upon modifying or changing the information earlier provided to Us, we find it difficult to
permit access to our Services to you due to insufficiency/ inaccuracy of the information, we
may, in our sole discretion terminate your access to the Services by providing you a written
notice to this effect on your registered email id.
d. If you wish to cancel your account or request that we no longer use your information to
provide you services, contact us through email address mentioned on the task bill received.
We will retain your Protected Information and Usage Information (including geo-location) for
as long as your account with the Services is active and as needed to provide you services.
Even after your account is terminated, we will retain your Protected Information and Usage
Information (including geo-location, task history, and transaction history) as needed to
comply with our legal and regulatory obligations, resolve disputes, conclude any activities
related to cancellation of an account, investigate or prevent fraud and other inappropriate
activity, to enforce our agreements, and for other business reason. After a period of time, your
data may be anonymized and aggregated, and then may be held by us as long as necessary for
us to provide our Services effectively, but our use of the anonymized data will be solely for
analytic purposes.
9. SECURITY:
The Protected Information and Usage Information we collect is securely stored within our databases,
and we use standard, industry-wide, commercially reasonable security practices such as encryption,
firewalls and SSL (Secure Socket Layers) for protecting your information. However, as effective as
encryption technology is, no security system is impenetrable. We cannot guarantee the security of our
databases, nor can we guarantee that information you supply won't be intercepted while being
transmitted to us over the Internet or wireless communication, and any information you transmit to the
Company you do at your own risk. We recommend that you not disclose your password to anyone.
10. BACKGROUND:
10.1Your privacy is very important to us. We respect your privacy and believe that we should clearly
and transparently disclose our privacy practices to you. This privacy policy (the “Privacy Policy”)
explains our policies regarding collection, use and disclosure of your personal information, personally
identifiable information and other data collected from you when you use our Services. This Privacy
Policy does not apply to any third-party Apps or applications. Please note that you shall visit any
third-party sites and apps at your own risk upon conditions laid down in their privacy policies, if any.
10.2 We may change, modify, amend, terminate or replace this Privacy Policy at any time at our
discretion. If we change, modify, amend or terminate this Privacy Policy, such modifications will
become effective immediately upon posting to the App and/or App. We will notify you of material
changes in advance by notifications through the App, notice when you log on to the App.
10.3 We will not use or share your information with anyone except as described in this Privacy
Policy. We use your information for providing and improving the Services. By using the Services,
you agree to the collection and use of information in accordance with this Privacy Policy.
10.4 You agree to periodically review the current version of the Privacy Policy, as posted on the App.
If you do not agree with the terms of this Privacy Policy, please do not use the App and its Services.
10.5 This Privacy Policy is to be read with, and is an integral part of, our Terms of Use available at in
the App. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the
same meanings as in our Terms of Use.
11. COLLECTION OF INFORMATION:
11.1 While using our Services, we may ask you to provide us with certain personally identifiable
information (“PII”) that can be used to contact or identify you. PII includes, but is not limited to, your
name, phone number, postal address, email address, enrolment number, student ID, Aadhar number,
and other information that by itself, or in conjunction with other information, can be used to
specifically identify you. However, PII does not include aggregated information that, by itself, does
not permit identification.
11.2 Information that we collect when you use our App and its Services includes:
(i) Information provided by you
When you sign up and register with us through the App, we ask you for certain information. This will
includes your name, email address, mobile number, enrolment number, student ID, Aadhar number,
details of company name & registration, company address, and details of legal mandates you wish to
use our App and its Services for.
Further, we ask you for certain information pertaining to each legal mandate that you may wish to list
on our Platform. This includes information such as your location, gender, other details required for the
service you may like to use, which is critical for the provision of our Services (“Mandate
Information”)
(ii) Log Data
With the help of third parties like Google and Facebook, we collect information that your mobile
device sends to them whenever you visit our Services ("Log Data"). This Log Data includes
information such as your computer's Internet Protocol ("IP") address, geo-location and geo-spatial
data, browser type and browser version. In case you are accessing the App, we may collect certain
mobile device information such as device ID, model number, operating system, global positioning
data, application, and other related information. We also collect data on the pages of our Services that
you visit, the time and date of your visit, the time spent on those pages, default language and user
preferences, and other similar usage related statistics. We may assign each user of the Services unique
identifiers to help keep track of future visits.
(iii) Payment information
Our Services require you to make payments on the Platform. When you are making any payments, we
collect billing details from you such as your name, name of company, billing address, contact number,
payment method and IP address, and then redirect you to a secure payment service provider platform
operated by our payments partner(s) Razorpay, Paytm etc and other payment partners which may be
added time to time. We do not store any payment related information such as credit/debit card details
and/or bank details.
(iv) Advertising, Use of Cookies, and Other Tracking Technologies (Cookie Policy) on our
Website/App. We advertise in a number of ways, including online through managed social media
presences, and on other unaffiliated sites and mobile applications. To understand how our advertising
campaigns are performing, we may collect certain information via our Sites through our advertising
service providers. We or our vendors use several common online tracking tools to collect information
about our users, such as browser cookies, web beacons, and other similar technologies. The
information we collect includes IP addresses, the number of page visits, pages viewed via our Sites,
search engine referrals, browsing activities over time and across other Apps following your visit to
one of our Sites or applications, and responses to advertisements and promotions on the Apps and
applications where we advertise. We do not permit third parties to advertise on our Site.
We also use certain information to:
· Identify new visitors to our Sites;
· Recognize returning visitors;
· Advertise on other Apps and mobile applications not affiliated with us;
· Analyze the effectiveness of our advertisements;
· Better understand our audience, customers, or other Site visitors; and
· Determine whether you might be interested in new products or services.
(v) Controlling Our Tracking Tools.
Your activity on app/browser may give you the ability to control cookies. How you do so, however,
depends on your browser and the type of cookie. Certain browsers can be set to reject all browser
cookies. If you configure your device/computer to block all cookies, you may disrupt certain
templates/app features/ web page features, and limit the functionality we can provide when you visit
or use our App/ Website/s. If you block or delete cookies, not all of the tracking that we have
described in this policy will stop. Some browsers have a “Do Not Track” feature that lets you tell
Apps that you do not want to have your online activities tracked. These browser features are still not
uniform, so we are not currently set up to respond to those signals.
(vi) Controlling Online Interest-Based Ads in the App / Website.
We sometimes work with online advertising vendors to provide you with relevant and useful ads. This
may include ads served on other companies’ Apps. These ads may be based on information collected
by us or third parties. For example, your geographical location may be used to target an ad for people
in your area. These ads may also be based on your activities on our Sites or on third party Apps.
(vii)Information received from others
We may combine information about you that we already have with information we obtain from other
sources, to provide you a better end user experience or to improve the quality of our Services.
Examples of information we may receive from other sources includes details of the Mandate
Information available to us, customer support or enrolment information, page view, search term and
search result information, and credit or identity information which we may use to detect fraud.
Please note that we use google analytics and similar kind of tools for the purpose of analytics and
measurement of the App and its services. For example, we may use the data gathered from your usage
of the App and its services by facebook, linkedin, twitter etc. to design new products or services, or to
make our existing offerings under the Services more user friendly.
2.3 Apart from the information listed above and the Mandate Information made available to us while
providing our Services, we do not collect any other sensitive information such as financial data,
political views of any individuals, health-related information or sexual orientation of any individuals,
information related to race, caste or language (Collectively, “Sensitive Personal Information”), unless
required by the provisions of any applicable law.
12. USE OF INFORMATION:
We use your PII and other information collected from you for the following purposes:
(i) To provide you with a customised and optimised experience with our App and its services;
(ii) To provide you with the functionalities of the App, and its services in a proper manner;
(iii) To track your usage of App and its services and customise the services/features/user experience to
best suit your requirements;
(iv) To send you communications, as per your notification settings, on any updates or developments
pertaining to the App and its services or your use of the services;
(v) To improve the security of the App and its services;
(vi) To protect our rights and property and the rights and property of our other users;
(vii) To provide you with information about new products or services launched by us or our partners;
(viii) To back up our systems to ensure preparedness for disaster recovery;
(ix) To provide you with customer support services, whether through app notifications, email, phone,
push notifications or messages within the App and its services;
(x) To provide you with technical service and support, including updates;
(xi) To combine your PII or other information with information obtained from other users on the
Platform, and publish summaries of aggregate data online or offline;
(xii) To provide information to third-parties performing services in support of our delivery of the
services to you;
(xiii) To communicate promotions and other offers, and for the purposes of advertisements;
(xiv) To improve the quality, features and functionality of the App and its services, including
measurement of service usage and efficiency of algorithms;
(xv) For the purposes of auditing, research and analysis to ensure the technical stability of the
Platform;
(xvi) To prevent and detect any fraud or other illegal activity on the Platform, and to prevent
violations of our Terms of Use;
(xvii) To respond to legal requirements, exercise our legal rights and defend against any legal claims,
to protect our interests or those of any third parties;
(xviii) To facilitate payment processes and verify payment information;
(xix) As may be necessary to enforce the terms of this Privacy policy and our Terms of Service.
13. STORAGE OF INFORMATION:
13.1 All data storage of your PII or other information collected from you through the app may be
stored and processed on computers located at the cloud servers provided by the Amazon Web Service.
Through your use of the app and its services, you unequivocally consent to the processing and
storage of your information.
13.2 We store some of your information on your device for subsequent retrieval and utilisation. We
take commercially reasonable care to encrypt this information on your device with passwords or other
secrets supplied by you. Such information stored on your personal device is subject to the security
offered by your device, browser and other components. You understand and agree that we cannot be
held responsible for any compromise of access to your personal device, for loss of information, theft
or for any exploits or logic attacks on your device through malware or other software or hardware that
is outside the control of our Services.
13.3 Although the security of your PII and other information is important to us, do remember that
no method of electronic storage or method of transmission over the internet / mobile app/s is 100%
secure. While we strive to use commercially acceptable and standard means to protect your
information, including internal reviews of our data collection, storage and processing practices and
security measures, we cannot guarantee absolute security in this regard. You provide your information
and PII to us at your own risk.
14. DISCLOSURE AND SHARING OF INFORMATION:
14.1 We may employ third parties to facilitate the App and its services, to provide the services on
our behalf, to help us analyse how the App and its services are used, or to perform task/service-related
services. We may share your information with third-parties in the following circumstances:
(i) We have obtained your consent, including when you choose to register a user account, use the app
and its services, and otherwise share your information with us, other users on the Platform and/or
other third-parties;
(ii) If sharing or disclosure of your PII or other information is necessary to provide you with the
Services;
(iii) If we have been purchased by a third-party;
(iv) If sharing or disclosure of your PII or other information with our associate entities, including any
related companies, successors, assigns, licensees, affiliates or business partners becomes necessary.
We require that these entities process your PII or other information solely as per our instructions and
in compliance with this Privacy Policy and any other appropriate confidentiality and security
measures;
(v) If your PII or other information is demanded by a court order or by governmental authorities;
(vi) If sharing or disclosure of your PII or other information is needed to help prevent against fraud or
the violation of any applicable law, statute, regulation, ordinance, or treaty;
(vii) If sharing or disclosure of your PII or other information is needed to protect our employees,
independent contractors, officers, members or other users; and
(viii) If otherwise permitted to do so by this Privacy Policy or by provisions of applicable law.
14.2 The following categories of recipients will most likely receive your information to enable us to
provide the Services to you:
(i) Third Party Data Centre Services such as Amazon Web Service;
(ii) Third Party SMTP Services such as gmail.com ;
(iii) Facebook, Instagram, for direct marketing;
(iv) Third party Service Providers such as Paytm, Razorpay etc.
14.3 All financial information collected on the Platform is used solely to enable payments as
consideration for the App and its services. No financial information collected on the Platform is used
for marketing or promotional purposes. Remember that if you provide any PII directly to a third party,
such as through a link on the App or the App, the processing is typically based on their standards
(which may not be the same as ours);
14.4 When any PII or other information pertaining to the users is shared with third-parties, such as
advertisers, licensees and content distributors, we shall ensure that such information shall be nonprivate, aggregated or anonymised so that it will not identify you personally. You understand that we
may further distribute your information to a wider audience through third-party Apps/ sites and
services, as long such distribution is consistent with this clause and other provisions contained in this
Privacy Policy.
14.5 We may use external advertising companies to serve advertisements when you have visited our
App. These companies may use anonymised information about your visits to this and other Apps in
order to provide advertisements about goods and services that may be of interest to you.
14.6 We may share PII with our parents, subsidiaries, divisions, and affiliates or as part of any sale,
merger or acquisition;
14.7 We will never sell your PII to unaffiliated third-parties without your approval at the time of
collection. You agree to inform us of any changes to your PII, and to protect the security of your
username, password and PII.
15. LEGAL BASIS FOR PROCESSING INFORMATION UNDER GDPR (GENERAL DATA
PROTECTION REGULATION) FOR USERS IN INDIA:
15.1 We process information of users in INDIA in accordance with INDIAN laws and regulations
such as the General Data Protection Regulation (“GDPR”). The GDPR governs how we process your
information and the rights that INDIAN users have in relation to your information. This entails that
we will collect and use your information only where:
(i) We need such information to provide you the Services and fulfil our obligations to you under our
Terms of Use. This includes the functionalities of the App /website;
(ii) The collection and use of your information is justified because of a legitimate interest such as for
research and development or marketing the App and its services (but only where our legitimate
interest isn’t overridden by your interest in protecting your information);
(iii) We have obtained your consent for using your information in a manner compliant with this
Privacy Policy;
(iv) The collection and use of your information is necessary for compliance with our legal obligations.
15.2 You may withdraw your consent for using your information at any time by writing to
info@gigsta.in . Where we are using your information because of a legitimate interest to do so, you
have the right to object to that use. However, if you do so, you may not be able to continue using the
functionalities of the App, and its services.
15.3 Please note that the provisions in this Clause 6 of this Privacy Policy are applicable only if you
are a user situated in the India and a data subject under provisions of the Indian GDPR.
16. RIGHTS WITH RESEPCT TO YOUR INFORMATION:
16.1 The laws of some countries grant particular rights in respect of your personal information. If you
are a user situated in the India, you may have the right to:
(i) Request a copy of your information and data portability: This right entitles you to know whether
we hold any PII about you and, if we do, to obtain a copy of such PII in a structured, commonly used
and machine-readable format;
(ii) Request that your information is deleted: This right entitles you to request the deletion of PII,
including in situations where such PII would no longer be necessary to achieve the purposes;
(iii) Request that we correct inaccuracies relating to your information: This right entitles you to have
PII to be corrected if it is inaccurate or incomplete;
(iv) Object to our use of your information: This right entitles you to request that we no longer process
your PII;
(v) Request that restrictions be placed on processing of PII: This right entitles you to request that we
only process PII in certain circumstances, including with consent.

16.3 If, at any time, you prefer not to receive communications from us, simply follow the delete
option of App /Google Play Store or App Store delete options or contact us directly at info@gigsta.in
. We will make commercially reasonable efforts to implement your opt-out requests promptly, but you
may still receive our emails for up to 7 (seven) working days as we process your request.
16.4 In some circumstances, we may not be able to comply with a request that you make in respect of
your personal information. For example, we may not be able to provide a copy of your information
where it infringes on the rights of another user. We may also be required to retain certain information
that you ask us to delete for various reasons, such as where there is a legal requirement to do so.
16.5 If we are unable to resolve your request, or if you are concerned about a potential violation,
you may be entitled to report the issue or make a complaint to the data protection authority in your
jurisdiction.
17. INFORMATION RETENTION:
17.1 Upon receiving a deactivation request / delete request, we will deactivate/delete your account
and all PII and Sensitive Personal Information collected by us will be destroyed. We retain nonpersonally identifiable information indefinitely for the purposes of analytics, subject to such
information being kept separate from other information that may constitute PII or that may, in
combination with such non-personally identifiable information, render the information personally
identifiable.
17.2 We collect and retain certain information that is required for our detection, investigation and
prevention of fraud, cheating and other violations of our Terms of Use and applicable laws
("Breach/es)"). This data is used only for the purposes of detection, investigation, prevention and,
where applicable, acting on such Breaches and stored only for the minimum amount of time needed
for the purpose of dealing with such Breaches. If the data indicates that such a Breach has occurred,
we will further store the data for the establishment, exercise or defence of legal claims, until a legal
case related to it has been resolved, or such legal claim no longer exists due to the expiry of relevant
limitation periods. Please note that the specific data stored for dealing with Breaches may not be
disclosed to you if such disclosure will compromise our legal rights as well as the mechanism through
which we detect, investigate and prevent such Breaches.

Gigsta hereby appoints Gigsta Support as the grievance officer for the purposes of the rules drafted
under the Information Technology Act, 2000, who may be contacted at info@gigsta.in. You may
address any grievances you may have in respect of this privacy policy or usage of your Protected
Information or other data to him.
19. CHANGES TO THIS PRIVACY POLICY:
We may update our Privacy Policy from time to time. You agree to periodically review the current
version of the Privacy Policy, as posted on the App. We will notify you of material changes in
advance by email or by notice on this page when you log on to the App. Changes to this Privacy
Policy is effective when they are posted on this page. If you do not agree to the change, you may
discontinue the use of Services.
